Terms of Service

These terms govern the consulting services provided by Bull Moose Strategy LLC ("BMS," "we," "us") to campaign committees, candidates, and organizations ("Client," "you"). By engaging our services, you agree to these terms.

Services

Bull Moose Strategy provides political digital advertising consulting, campaign strategy, website development, social media management, digital security auditing, and related services for local and state-level political campaigns. All services are described in the service agreement executed between BMS and the Client prior to work beginning.

Consulting Fees & Payment

One-Time Engagements

One-time consulting fees (Ads Only, The Blitz, Campaign Ready) are due upon execution of the service agreement. Payment is accepted via credit card or ACH through our payment processor, Stripe.

Monthly Retainers

Monthly retainer fees (The Machine, Stay Elected) are billed on the first of each month. The first month's retainer is due upon execution of the service agreement.

Late Payments

Invoices not paid within 15 days of the due date may result in a pause of active advertising campaigns and consulting services until the balance is resolved.

Advertising Spend

BMS does not collect, hold, manage, or refund advertising spend. Clients pay advertising platforms (Google, Meta, YouTube, etc.) directly using their own payment method on file with each platform. BMS sets up and manages campaigns on the Client's behalf, but all ad billing flows directly between the Client's campaign committee and the advertising platform.

BMS consulting fees are separate from and independent of advertising spend. Our fees cover strategy, setup, management, optimization, and reporting — not media purchases.

Refund policies for advertising spend are governed entirely by each advertising platform's own terms of service. BMS has no ability to issue refunds for money paid to Google, Meta, or any other advertising platform.

Refund Policy

Before Work Begins

If a Client cancels before any work has been performed, a full refund of consulting fees will be issued within 14 business days.

After Work Begins

Once work has commenced — including but not limited to account creation, strategy development, content creation, ad setup, or website development — consulting fees are non-refundable. Due to the nature of consulting services, significant resources are allocated immediately upon engagement, and this work cannot be undone or returned.

Monthly Retainers

Monthly retainer fees are non-refundable for the current billing period. Retainers cover the commitment of ongoing availability, monitoring, and management throughout the month.

Cancellation Policy

One-Time Engagements

One-time engagements may be cancelled before work begins for a full refund. Once work has begun, the engagement will be completed as scoped in the service agreement. If a Client wishes to discontinue mid-engagement, fees paid are non-refundable, but BMS will deliver all work completed to date.

Monthly Retainers

Either party may cancel a monthly retainer engagement with 30 days' written notice sent to the other party via email. The retainer will remain active through the end of the current billing period plus the 30-day notice period. No refund is issued for the final billing period.

Election Timing

Cancellations within 14 days of an election date are strongly discouraged, as active advertising campaigns may be disrupted. BMS will make reasonable efforts to wind down campaigns responsibly if cancellation occurs during this period.

Dispute Resolution

If you have a concern about services provided, contact us directly at [email protected]. We are committed to resolving issues promptly and fairly. If a resolution cannot be reached informally, disputes will be governed by the laws of the State of Ohio and resolved in the courts of Licking County, Ohio.

Intellectual Property

Upon full payment, the Client owns all campaign-specific deliverables including website content, ad creative, social media content, and campaign materials created by BMS. BMS retains the right to use anonymized campaign data and results for case studies and marketing purposes unless the Client opts out in writing.

Confidentiality

BMS will not disclose confidential campaign information, strategy details, opposition research findings, or digital security audit results to any third party without the Client's written consent. This obligation survives the termination of the engagement.

Limitation of Liability

BMS provides digital advertising and consulting services on a best-efforts basis. We do not guarantee election outcomes. Our liability is limited to the total consulting fees paid by the Client for the specific engagement in question. BMS is not liable for decisions made by advertising platforms, changes to platform policies, or actions taken by third parties.

These terms are subject to the specific service agreement executed between BMS and the Client. In the event of a conflict, the service agreement governs. These terms are pending attorney review and may be updated.
